General

Before using the website, we recommend reading both the Terms & Conditions and the Privacy Policy. By accessing this website, our social media platforms and making a purchase of products from us you are agreeing to be bound by these Terms and Conditions.

With a Pop reserves the right to update or modify our Terms and Conditions at any time without prior notice by posting updated terms of use on the website. The Terms and Conditions that will apply to your order are the ones that are available on the website at the time of which we accept your order. For this reason, we encourage you to review our Terms and Conditions each time you purchase from us.

With a Pop does not guarantee that this website will be free from viruses or the access to the website will be uninterrupted.

Retail prices are in Australian dollars. Prices displayed on With a Pop website are subject to change without further notice. By placing an order online with www.withapop.com you are agreeing to pay and purchase the product at the price stated on the site and any applicable charges.

Due to inventory system errors we may occasionally have the item(s) you purchase unavailable. In this case, you will be refunded for the item(s) or offered an alternative product. We will not be liable to any person if we decline to fulfil or are unable to fulfil an order. We also reserve the right to cancel an order and refund any payments made.

 

Delivery

With a Pop offers delivery around the local area of Albury/Wodonga. Delivery times can be any time between 9am - 4pm on selected days. We are unable to specify an exact time for the delivery. Occasionally situations may arise which are out of our control resulting in slight delays in the mentioned time frames. We cannot accept responsibility for these unfortunate events but assure you that every effort is made to ensure your goods arrive within that time.

In the rare occasion where your balloon(s) pop during transport while still in our care, we may not always be able to replace therefore a refund will be issued. If a replacement is the case, then delays will occur.

We recommend you use a business address if there is a chance the recipient is not likely to be home. With A Pop requests that the recipient, be available to receive the delivery on the day of delivery. If no one is available to accept the delivery, then the product will be left unattended outside the premises, beyond this point the product will no longer be our responsibility. Due to the number of deliveries, With a Pop is not always able to contact the gift-recipient or other parties when the requested delivery location is unattended. It is important that the customer provides clear and accurate delivery instructions when placing their order. With a Pop retains records for proof of delivery, and remains exempt from any liability or responsibility for loss or damage arising as a result of parcels being left safely and securely outside of the unattended premises or due to an incident arising from 'returned, popped, melted, infested or undelivered' products. Should the delivery address supplied by the customer be incorrect or insufficient details provided, With a Pop cannot accept any responsibility for any loss experienced. It is the obligation of the customer to supply accurate details at the time of order.

Picking Up

Pick up is ONLY available between 10:00am - 2:00pm Tuesday to Friday and 8.00am -10.00am on Saturday at our residence in Wodonga 3690. Pick up is NOT available outside of these times. Please ensure you are available to pick up during these times to avoid disappointment.  We know that things can happen and sometimes plans fall through, if you are unable to pick up and require us to deliver your order to you, please contact us and we will see what we can do.

Please note: that we may not be able to deliver your item by the time or day that its needed if you are unable to pick up, there will also be a delivery fee that will be at your expense.

When picking your balloons up (Gift Balloons, Garlands, Inflated Balloons) please make sure there isn't anything sharp in the car that may pop your balloon. During summer period or warmer temperature, it is critical not to leave your Balloons or Dessert Boxes inside the car for an extended period of time as the air inside the balloons will expand and may cause your balloons to pop or the treats inside your Dessert Boxes may melt. The same rule applies about leaving your balloons outside in the open air or anywhere in the sun. Please ensure your car opening is big enough to fit the balloons inside. Once the products are made, we cannot reduce its size and it is not our responsibility if they don't fit in your car - no refunds will be given.

Refunds

Due to the nature of these products they are fragile and may pop so we advise that you take the best of care with them. Refunds may only be provided if the incorrect item has been provided or if balloons have popped in our care before delivery and a replacement is unable to be provided. We ensure all balloons are made a couple of hours prior to the event to allow enough time to show us if there are any faults to the balloon. Once the balloon is out of our care, we will not be liable should they deflate or pop for any reason.

If the products are being used for a Gender Reveal announcement, we do not accept refunds unless in the unlikely occasion where With A Pop provides the wrong gender from the advice provided. Written proof to justify the incorrect preparation must be provided e.g. letter, email or text sent prior to event date and picture of the incorrect colour provided by With A Pop dated.

Changes and Cancellations

Once placed via the With a Pop website orders are considered final. If you wish to cancel your order, please contact With A Pop immediately by email Hello@withapop.com or phone 0407 349 401. Cancellation before three (3) days of pick up/delivery date of your order will not receive a refund and applies to all products except for "additional gifts". Once payment for an order has been accepted, cancellation is at the discretion of With A Pop. During sales we are not able to add or change orders once final.

Customer Care

Once the products are in the care of the customer, it is up to the customer to ensure the products do not melt, pop or become damaged.  With A Pop do not take any responsibility for any damage once handed to the customer.

Regarding Gift Balloons: We recommend these to be Picked-up/Delivered on the day of event or one day Prior (the balloon itself can last over a week however clouding can appear). When picking up Gift Balloons, you must ensure clear space in boot or seats to ensure the product is sitting well and clear of anything that could damage it and where possible be placed on a flat surface. The items styled inside the balloons are not secured by anything and are only placed in the balloon. When moving the Gift Balloons around we advise you handle with caution and care, no fast movements, drive slowly with extra care around turns and roundabouts and refrain from breaking hard and suddenly to ensure the stability of the product. 

Custom Orders & Personalisation

With A Pop does not take any responsibility for the content on any messages or personalisation on products sent from a sender to a recipient. Messages and personalisation are not altered or censored by With A Pop and are sent as requested by the sender. We advise that you take great care when writing your messages or notes for personalisation as With A Pop will be printing as is from the customer and will not take any responsibility for misspelt names or words.

Options for Shredded Paper and Ribbon can be chosen however if we are out of stock, we will automatically choose the next best colour to suit the balloon style. If you place a custom order through us, we will do our best to meet your brief, however creative license is left with us.

Gender Reveal Balloons

We accept advice of the gender by online orders, email, text and letter. We also accept advice by telephone calls from family, friends or the Sonographer. We will always write down the gender on paper once we are advised over the phone however we will not be liable if the information provided to us is incorrect due to the Sonographers misreading of the ultrasound/test.

H-float is not able to be used in gender reveal balloons therefore the float time is approximately 8 hours however we recommend popping the balloon within 5 hours of receiving the balloon.

If personalisation is applied to your balloon, you may see it wrinkle over a few hours. This is normal and not a fault.

Ownership of Information

With a Pop creates the pictures and descriptions for this website and our social platforms. All information, visual and text, is owned by With a Pop and may not be used by any other party without the express permission of With a Pop. Taking of any content, visual or text, will be deemed as a breach of copyright.

Advertised Goods / Colour Representation

With a Pop displays products in a variety of ways, however colours displayed on a computer or phone screen vary and may not represent the exact colours.

With a Pop takes every effort to ensure that all our products look as close to the photographic representations displayed on our website. Balloons garlands will differ in portion of colour and position of each balloon. No balloon garland will be the same and due to the nature of this product we will ensure to prepare the balloon garland the best way we see fit. 

Installation

Balloon garlands will come partially prepared and the remainder will be added on site when being set up. We base each garland by your ordered length therefore we cannot extend the length on the day of the event.

We recommend installation to be prepared on the day or the night before the event if the balloon garland is being displayed indoors. Due to the temperament of balloons, some may pop over and you may see them change to have matte finish over time and clear or confetti balloons will become cloudy. Balloon garlands can stay inflated in good condition for anywhere between 4 days to weeks after the event dependant on its care and the environment it is held in however this cannot be guaranteed. 

In the case that there are no suitable points to hang the garland on command hooks will be used at private residences and we will seek permission to use them to fix balloon garlands where necessary. Photos of the area in which you’d like the garland hung may be required to allow us to better visualise and advise on the type, style and how to hang.

If you are purchasing a balloon garland at a hired venue we will not use command hooks, so if there are no suitable points to be able to hang the garland you may be required to hire the correct props to allow us to place the balloon garlands on. Please note that the hire of props will be at your cost.

We can arrive to install at your event either the day of or night before to set up depending on your venue. Please contact us to confirm the best time and allow a few hours for us to install.
